Let me first explain what you're facing and how we may approach your defense. In Michigan, what many call a "DUI" is legally termed "Operating While Intoxicated" (OWI). Simply stated, you don't actually need to be driving to be charged with this offense. "Operating" encompasses more. Most people don't realize the harsh consequences that can result from an OWI conviction. Unlike some states, Michigan doesn't offer "first-offender" or deferred judgment programs for these charges and, until recently, convictions traditionally remained on your criminal record forever, available for public inspection by prospective employers.
If your blood alcohol level was .17 or higher (what we call "superdrunk" cases), that potential maximum jail time increases to 180 days. Penalties also include up to two years of probation, mandatory driver license suspensions, and points against your master driving record. An automobile interlock device could be required, even for a first offense "superdrunk" charge.
However, there's important news: Recent legislation now allows first offense OWI convictions to be expunged from your record. This is a significant change that could help protect your future opportunities.
From the moment of arrest, an effective defense can begin. Proper proactive steps can influence bond conditions, which can be very expensive and burdensome and sentence terms, if any. Bond conditions will likely include orders not to possess or drink alcohol or use illegal drugs, and even recreational marijuana. Depending on your alcohol test results at arrest, many judges require daily breath testing or monitoring device use throughout your case.
